Nissan Motors-Directed to Refund Cost or Replace a Defective Micra Car

Nissan Motors India has been directed by a consumer forum to replace a defective Micra car or refund the cost, sold to a doctor, Dr. Neera Bhan. Nissan is held liable by the East District Consumer Disputes Redressal Forum and directed to refund the cost of the vehicle or replace it, saying the car's defective braking system place the complainant in a "constant danger" of getting hurt while driving the car.

Nissan is even directed to pay Rs. 50,000 as compensation to the complainant. Dr. Bhan had bought the Nissan Micra car in 2011, which made a sharp sound when brakes were applied. Even after sending the car several times to repair, the faulty brake system continued to persist. In 2012, the brake assembly was replaced even though the problem didn’t get rectified.

The Japanese auto maker in its defence had denied the allegation that the car was defective saying, the car had covered 30,000 km. However, the consumer forum rejected the contention stating "coverage of 30,000 km cannot be a defence in view of the clear admission of replacement of the break assembly."
